Terms of Service

• These Terms apply to every individual and organization that accesses or uses any of our services, regardless of access channel (web, mobile, desktop, API, integration).
• If you accept these Terms on behalf of an organization, you confirm that you have authority to bind that organization, and references to "you" include that organization.
• Additional service-specific addenda may apply to certain products. Where they exist, those addenda are incorporated by reference and prevail in case of conflict on product-specific matters.

• You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
• You are responsible for the accuracy of the information you provide and for keeping your credentials confidential.
• You are responsible for activity performed under your account. Notify us promptly of any suspected unauthorized access.
• We may suspend or terminate accounts used in violation of these Terms, applicable law, or the security of other users.

When you use a service in the context of an employer, client, or partner organization, that organization typically administers your workspace. The organization may configure data-handling settings, grant or revoke access, export your records, or delete data within the workspace. You should consult your organization's internal policies for those configurations.

You agree not to:

• Use our services for any illegal, fraudulent, or infringing purpose, or in violation of applicable export-control or sanctions regulations.
• Attempt to interfere with the integrity or performance of our services, including denial-of-service attempts, vulnerability scanning without prior written authorization, or reverse engineering beyond what local law permits.
• Probe, scan, or test the vulnerability of any system or network unless we have provided explicit written authorization.
• Upload content you do not have the right to share, content that infringes intellectual property rights, or content that contains malware, exploit payloads, or unlawful material.
• Use automated means to extract data from our services beyond a published API rate limit, or build derivative datasets without our written authorization.
• Impersonate any person or entity, or misrepresent your affiliation.

• Paid plans, when offered, are billed in advance on the cadence specified at the time of purchase (monthly, annual, or as agreed in a written order form).
• Unless required by law, fees are non-refundable once the corresponding service period has begun.
• Taxes and duties applicable to your jurisdiction are added on top of stated fees.
• We may change pricing for future renewal periods with reasonable advance notice. Continued use after the new pricing takes effect constitutes acceptance.

Your use of our services is also governed by our Privacy Policy, GDPR Compliance Statement, Data Retention Policy, and Security & Data Protection page. Where we process personal data on your behalf, the applicable Data Processing Addendum (DPA) is incorporated by reference.

All intellectual property rights in our services — including software, designs, content, marks, and documentation — belong to Khalid Aboubakr and Sigmantic Digital Technology or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use our services in accordance with these Terms.

You retain all rights in the content you upload. You grant us a limited license to host, transmit, render, and back up that content solely as necessary to provide the service.

We continuously improve our services and may add, modify, or retire features. We may also update these Terms — for example, to reflect legal changes, new features, or operational needs. Material changes will be communicated through prominent in-product notice or via email to active administrators. Your continued use after the effective date of the updated Terms constitutes acceptance.

To the maximum extent permitted by applicable law, our services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the services will be error-free or meet your specific requirements.

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, or business opportunity, arising out of or relating to these Terms or the services, even if advised of the possibility of such damages. Each party's aggregate liability under these Terms will not exceed the amounts paid or payable for the affected service in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by applicable law (for example, liability for gross negligence, willful misconduct, or death and personal injury where such limitation is prohibited).

You agree to defend, indemnify, and hold harmless Khalid Aboubakr, Sigmantic Digital Technology, and our personnel from and against any third-party claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the services, or content you have uploaded.

• You may stop using our services at any time and close your account through the in-product settings or by contacting us.
• We may suspend or terminate access where you materially breach these Terms, fail to pay applicable fees, present a security risk, or where required by law.
• On termination, the rights granted to you cease. Provisions that by their nature should survive (intellectual property, confidentiality, liability limitations, governing law) survive termination.

These Terms are governed by the laws applicable at the principal place of business of Khalid Aboubakr / Sigmantic Digital Technology, without regard to conflict-of-laws principles. The parties will attempt in good faith to resolve any dispute through written negotiation before resorting to formal proceedings. Mandatory consumer protections in your country of residence are not affected.

• Entire agreement. These Terms, together with the Privacy Policy and any addenda, form the entire agreement between you and us regarding the services.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• No waiver. Failure to enforce any right is not a waiver of that right.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a corporate restructuring, merger, or sale of assets.
• Force majeure. Neither party is liable for delay or failure caused by circumstances beyond reasonable control.
